In an update on the lawsuit brought by the family of Nancy Toffolini Benoit against Hustler Magazine, Christian Boone of the Atlanta Journal Constitution notes that a federal appeals court in Atlanta, Georgia sided with Hustler Magazine in a dispute over nude pictures of Benoit that were published shortly after her unexpected death at the hands of her husband Chris Benoit.

The court stated that there wasn’t enough evidence to back a jury’s decision requiring that Hustler Magazine award the family of Nancy Toffolini Benoit a fee in the region of $20 million. The family of Nancy noted that she never gave permission to Hustler Magazine to publish the photos, while the magazine disputed that it could print them because they were newsworthy.
